Lastly, take the opportunity to thank the officer for their service.
Be careful with hanging any object from your rearview mirror. It is not illegal in Florida to do so but it is in many states.
Florida Statute 316.294 makes it mandatory for all vehicles to have a rearview windshield.
Further Florida Statute 316,2004 makes it a traffic violation to obscure your view.
Section 316.2004(2)(b) forms part of the Florida Uniform Traffic Control Law. It provides:
No person shall drive any motor vehicle with any sign, poster, or other nontransparent material upon the front wind-shield, side wings, or side or rear windows of such vehicle which materially obstructs, obscures, or impairs the driver’s clear view of the highway or any intersecting highway.
Pursuant to section 316.2004(3), a violation of section 316.2004(2)(b) is a noncriminal traffic infraction, punishable as a nonmoving violation as provided in chapter 318, Florida Statutes.
Therefore, officers have made an argument that anything hanging from your rear view mirror could obstruct your view and thus probable cause for a traffic stop.
An officer can also argue based on
A person shall not operate any motor vehicle on any public highway, road, or street with any sign, sunscreening material, product, or covering attached to, or located in or upon, the windshield, except the following:
(a) A certificate or other paper required to be displayed by law.
(b) Sunscreening material along a strip at the top of the windshield, so long as such material is transparent and does not encroach upon the driver’s direct forward viewing area as more particularly described and defined in Federal Motor Vehicle Safety Standards No. 205 as the AS/1 portion of the windshield.
(c) A device, issued by a governmental entity as defined in s. 334.03, or its designee, for the purpose of electronic toll payments
Therefore, it is prudent to avoid any such issues by leaving a clear unobstructed view through the front windshield with no object hanging from the mirror.
